Our belief is that a holistic approach is required to effectively combat counterfeiting in Africa, combining both traditional and non-traditional enforcement measures in developing an implementing an effective anti-counterfeiting strategy in South Africa as well as key market areas in Africa.

Traditional IP protection measures are territorial in nature and the rights and enforcement measures available to brand holders is based on the laws and procedures in each specific territory and region. This is however in direct contradiction to the usual supply and distribution methods of counterfeit and illicit goods, which are not confined to territorial borders, and where cross border trade is encouraged for economic reasons.

Our approach is to deal with counterfeit and intellectual property infringement on a regional basis, considering the trade and movement of goods within the region, using appropriate and available enforcement measures.

An approach is therefore required which is based on a clear understanding on the importation methods, cross-border trade practices, main trade routes, supply distribution and sale of counterfeit and illicit goods, in order to effectively combat counterfeit goods in the market place. As such, in order to effectively combat anti-counterfeiting in key markets, it is essential to have an understanding of the procedures and processes in the flow of the goods, and to implement measures from the landing of these goods, the identification of current methods in the cross-border trade of these goods in order to identify and detain these goods at borders, as well as the enforcement within the market place.

A one-fits-all approach cannot be taken in respect of counterfeit goods, as there is no one specific procedure or legislative measure that can effectively deal and combat the trade in illicit and counterfeit goods.

As a result of the skills acquired in both traditional and non-traditional protection and enforcement of IP rights (Trade mark and copyright specifically), acquiring knowledge and expertise in the area of anti-counterfeiting trade practices and measures available cross-border and in neighbouring territories, we are able to provide a unique approach to anti-counterfeiting, with a strong focus on industry related aspects, incorporating a number of different tools and methods in combatting counterfeits both at borders and in the market.

A key area of focus is building and maintaining strong relations with government offices involved in illicit and anti-counterfeiting measures. This involves identifying key role players on all levels and working together with government officials in increasing knowledge, awareness and capacity building.

We work together with a network of experienced agents and investigators who have been chosen based on their knowledge and expertise of the markets, importation and source and supply of goods.

Our key focus is to collect, assess and integrate the intelligence gained from the agents, investigators and officials, in order to strategically deal with counterfeit goods at the various points within the supply chain from source to market.
